All products and services offered on this Website — including photographic prints, artworks, books, photo books, and digital publications — are sold directly through marusazamorano.com and are operated exclusively by DFilm Pictures, Maruša Zamorano s.p.

By using the Website, the user agrees to these Terms & Conditions. If the user does not agree, they must refrain from using the Website.
The operator reserves the right to amend these Terms at any time without prior notice. Changes become effective upon publication on the Website.

5. Purchases, Payments, and Delivery

a) Purchases

All purchases are completed directly on marusazamorano.com and are legally processed by DFilm Pictures, Maruša Zamorano s.p.

b) Payments

Payments are processed through secure systems (e.g. Stripe, PayPal, or bank transfer).
All prices are listed in EUR and include VAT unless explicitly stated otherwise.

c) Delivery

  • Digital products (e-books, photo books, guides, digital publications) are delivered electronically after payment confirmation.

  • Physical products (photographic prints, artworks, books) are dispatched within 5–10 business days, unless otherwise stated (custom works, limited editions, or force majeure).

d) Shipping Costs

Shipping costs are calculated at checkout and clearly displayed before order confirmation.

6. Damages and Issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged, or if you receive the wrong item, so that we can evaluate the issue and make it right.

7. Returns, Exchanges, and Refunds

a) Sale Items and Gift Cards

Statutory consumer rights, including any applicable right of withdrawal, also apply to discounted products.

Gift cards and other products are subject to the applicable statutory rules and exceptions.

b) Exchanges

The fastest way to ensure you get what you want is to return the item you have.
Once the return is accepted, you may place a separate new order for the desired item.

c) Refunds

We will notify you once we have received and inspected your return and inform you whether the refund has been approved.

If approved, the refund will be automatically issued to the original payment method.
Please note that it may take some time for your bank or credit card company to process and post the refund.

8. Right of Withdrawal (EU Consumers)

a) Physical Products

Consumers have the right to withdraw from an online purchase within 14 days of receiving the goods, without providing a reason, unless a statutory exception applies.

To exercise this right, the buyer must notify DFilm Pictures, Maruša Zamorano s.p. at info@marusazamorano.com before the withdrawal period expires.

The goods must be returned within 14 days after notification of withdrawal. The buyer bears the direct cost of returning the goods.

Where the right of withdrawal is valid, payments received from the buyer, including the cost of standard delivery, will be refunded in accordance with applicable law. Additional delivery costs resulting from the buyer choosing a delivery method other than the least expensive standard delivery offered are not refundable.

b) Custom and Personalised Photographic Works

The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised.

This exception may apply to photographic works produced according to an individual customer's specifications, including specially requested sizes, formats, materials, finishes, framing, or other personalised production requirements not offered as a standard product on the Website.

Photographic prints offered in standard sizes and specifications on the Website remain subject to the statutory right of withdrawal unless another legal exception applies.

c) Digital Content

For digital content supplied electronically, the right of withdrawal may cease once delivery or access has begun, provided that the consumer has expressly consented to immediate delivery and acknowledged that this results in the loss of the right of withdrawal, as required by applicable law.

d) Damaged or Non-Conforming Products

The above withdrawal rules do not affect the consumer's statutory rights where a product is defective, damaged, incorrect, or otherwise not in conformity with the contract.

9. Personal Data Protection

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Slovenian legislation.

10. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of the Republic of Slovenia.

Any disputes arising from the use of the Website or purchases made through it shall be subject to the jurisdiction of the competent court in Ljubljana, unless mandatory law provides otherwise.

11. About the Store

This is not a mass-market store.

Marusa Zamorano is a small, independent, family-run artistic studio and publishing space, created out of long-term work, authorship, and care.

Every photograph, print, book, and project is developed slowly and intentionally — from creation to final delivery.

Continued use of the Website constitutes acceptance of the updated Terms.

13. Packaging

We aim to use as little packaging as possible. Most physical orders are delivered by personal hand-over within Slovenia. When packaging is needed, we source it from local suppliers (including the post office and packaging providers) and request confirmation that the materials comply with the applicable requirements of Regulation (EU) 2025/40 on packaging and packaging waste (PPWR). We keep the relevant supplier information and strive to choose simple, recyclable options. By limiting deliveries to hand-over within Slovenia we significantly reduce the amount of transport packaging used.
